A lot of companies think they’re “safe” from AI compliance risks simply because they haven’t formally adopted AI. But that’s a dangerous assumption—and it’s already backfiring for some organizations. Here’s what’s really happening— Employees are quietly using ChatGPT, Claude, Gemini, and other tools to summarize customer data, rewrite client emails, or draft policy documents. In some cases, they’re even uploading sensitive files or legal content to get a “better” response. The organization may not have visibility into any of it. This is what’s called Shadow AI—unauthorized or unsanctioned use of AI tools by employees. Now, here’s what a #GRC professional needs to do about it: 1. Start with Discovery: Use internal surveys, browser activity logs (if available), or device-level monitoring to identify which teams are already using AI tools and for what purposes. No blame—just visibility. 2. Risk Categorization: Document the type of data being processed and match it to its sensitivity. Are they uploading PII? Legal content? Proprietary product info? If so, flag it. 3. Policy Design or Update: Draft an internal AI Use Policy. It doesn’t need to ban tools outright—but it should define: • What tools are approved • What types of data are prohibited • What employees need to do to request new tools 4. Communicate and Train: Employees need to understand not just what they can’t do, but why. Use plain examples to show how uploading files to a public AI model could violate privacy law, leak IP, or introduce bias into decisions. 5. Monitor and Adjust: Once you’ve rolled out your first version of the policy, revisit it every 60–90 days. This field is moving fast—and so should your governance. This can happen anywhere: in education, real estate, logistics, fintech, or nonprofits. You don’t need a team of AI engineers to start building good governance. You just need visibility, structure, and accountability. Let’s stop thinking of AI risk as something “only tech companies” deal with. Most AI systems in use today are built on third-party tools. That includes models, datasets, and full platforms. But using a vendor’s product DOES NOT remove your responsibility. Under most AI regulations, the deployer (likely YOU) is accountable for how the system performs and whether it causes harm. #ISO42001 helps organizations manage that risk. It provides a structure for assigning roles, reviewing supplier practices, validating documentation, and managing risk across the lifecycle of the AI system. The standard requires you to: 🔸Define who is responsible for each part of the system (Annex A.10.2) 🔸Put a process in place to evaluate and monitor suppliers (Annex A.10.3) 🔸Confirm that technical documentation is available and complete (Annex A.6.2.7) 🔸Reflect supplier-related risks in your own planning and contracts (Clause 6.1.3 and Annex A.10.4) Clause 8.1 is clear. You must control how external systems are used inside your organization. This means you cannot treat vendor models as a black box. You are expected to evaluate them and take action if there are risks. 🚨 Huge AI policy news for the Australian public service! The Government has just released its Australian Public Service (APS) AI Plan 2025, a major blueprint for how the APS will use artificial intelligence to deliver better, faster services for Australians. This is a practical plan that moves beyond ambition to focus on execution. It’s about ensuring the APS has the tools and the judgement to use AI responsibly, with AI leaders embedded in agencies to drive adoption. The plan rests on three pillars: 1️⃣ Trust: transparency, ethics and governance 2️⃣ People: capability building and engagement 3️⃣ Tools: access, infrastructure and support Key initiatives: 💡 GovAI – secure, onshore generative AI platforms 📜 A strengthened Responsible AI Policy, with mandatory AI strategies, impact assessments and accountable officers and a register for use cases 🧩 Chief AI Officers to drive safe, coordinated adoption 🤝 Supplier obligations – requirements that suppliers declare and take responsibility for AI use 🧠 Mandatory AI literacy and leadership training across the entire public service ☁️ A new whole-of-government cloud policy to unlock AI’s potential securely This is a major statement of intent from the Government: agencies are expected to lean in, not sit back on AI. My thoughts: 📄 Responsible AI policy overhaul coming: The current policy was fairly light. Expect an update by year’s end to embed clearer accountability, risk management and governance expectations. 🔨 Use-case-level governance: I’ve long argued that AI governance works best at the use-case level, not the system level. The Government agrees. The approach appoints accountable officers for use cases, which is the kind of granularity needed for real accountability. 👀 Central oversight: An AI Review Committee will scrutinise higher-risk use cases. This creates a feedback loop that allows lessons, failures and fixes to be shared across government rather than buried in individual agencies. It’s a smart step toward building consistency and collective trust. 💪 Massive capability uplift: Every public servant will receive foundational AI literacy training and rightly so. An AI tool is only as good as the hands it’s in, and training must cover responsible use AND effective use. 📡 Trust through communication. The plan directly acknowledges Australia’s trust gap on AI and puts communication and engagement at the core. 📶 A new benchmark for industry. A whole-of-government AI governance framework like this could very well become the de facto standard for everyone doing business with government and beyond. Requirements will inevitably flow through supply chains. Big picture: the aim is to boost service delivery, policy outcomes and productivity while fostering public trust. We are not yet ready for this. A growing army of autonomous agents are engaging with not just humans and other agents, but also economic and legal institutions. An "agent infrastructure" of systems and protocols could maximize benefits and contain risks, suggest a group of researchers from Centre for the Governance of AI (GovAI) Harvard Law School University of Oxford University of Cambridge and others (link in comments). Most AI safety research is focused on AI system-level interventions. However different approaches are required in a proliferating multi-agent environment. The researchers propose 3 major functions in effective agent infrastructure: Attribution, Interaction, and Response: 💡 Attribution: Ensuring accountability. Attribution is critical for linking AI agent actions to responsible parties, such as users or organizations. Mechanisms including identity binding, to associate an agent’s actions with a legal entity. Certification provides verifiable assurances about an agent’s behavior, such as data handling policies or autonomy levels. Implementing agent IDs enables tracking and monitoring specific agents, facilitating incident response and accountability. 🤝 Interaction: Shaping behaviors. Interaction infrastructure defines how agents engage with the world to enable reliability and security. Dedicated agent channels isolate agent activities from regular digital traffic, reducing risks like data contamination or accidental disruptions. Oversight layers empower users or managers to intervene when necessary, improving operational control and accountability. Inter-agent communication protocols support seamless collaboration and negotiation among agents, promoting cooperative outcomes in multi-agent systems. 🔄 Response: Mechanisms to mitigate harm. Response infrastructure addresses problems caused by agents using proactive and reactive measures. Incident reporting systems collect detailed data on harmful events, enabling developers and regulators to understand root causes and implement safeguards. Rollback mechanisms allow reversal of unintended actions, such as erroneous financial transactions, protecting users from significant harm. The concept of agent infrastructure and proposed framework provide a very useful framework to build the next phase of scalable agent ecosystems. We need to develop and agree on these principles soon, as the foundations of a burgeoning agent economy will be built through this year.

Yes, we’re all excited about AI’s potential but what if it takes the wrong decision, one which can impact millions of dollars or thousands of lives - we have to talk about accountability. It’s not about: Complex algorithms. Elaborate protocols. Redtape. The solution is rooted in how AI and humans work together. I call it the 3A Framework. Don't worry, this isn't another buzzword-filled methodology. It's practical, and more importantly, it works. Here's the essence of it: 1. Analysis: Let AI do the heavy lifting in processing and analyzing vast amounts of data at incredible speeds. This provides the foundation for informed decision-making. 2. Augment - This is where the magic happens. Your knowledge workers, with all their experience and intuition, step in to review and enhance what the AI has uncovered. They bring the contextual understanding that no algorithm can match. 3. Authorization - The final step is establishing clear ownership. No ambiguity about who makes the final call. I grew up watching machines go rogue🤖 Now I help companies stop that from happening in real life. 🦾 Growing up, I loved watching sci-fi movies. In the 90s, the theme was always the same: man creates a scientific marvel, man loses control over said marvel… cue the running, screaming, and inevitable bloodshed. As a kid, I lapped up those stories, which always hammered home one moral: humans messing with the laws of nature never ends well. Fast forward to today, and I find myself advising companies on a very real version of that narrative, which is using AI in HR. With AI tools increasingly used to monitor performance and even flag employees for dismissal, the question isn’t just “can we do this?” but “should we? And how do we do it fairly?”. I recently shared my views on this topic with HRD Asia (link to article in the comments below). In general, HR teams must get the following right: 🔹 Transparency: Employees should know how their performance is being assessed and what data is being used. 🔹 Human Oversight: AI should assist human judgment. It can never replace it. Accordingly, a meaningful review process is essential. 🔹 Vendor Accountability: Employers must understand how third-party tools work and ensure they don’t produce biased outcomes. 🔹 Appeal Mechanisms: Employees need a way to challenge decisions influenced by AI. 👨⚖️ In my practice, I’ve already seen clients ask whether an AI-generated score is enough to justify dismissal. My answer? Not without human validation and a clear explanation of how the score was derived. Implementing a Human-In-The-Loop approach to any automated scoring tools would also ensure that any employment decision is validated by an employee who can justify the AI-generated recommendation. This is especially important in employment decisions relating to summary dismissal which carry significant legal risks, such as wrongful dismissal claims. While there is no hard and fast rule when it comes to determining the appropriate level of intervention, the key principle is that the reviewer must be able to understand how the AI arrived at its decision and the individual must have the authority to override it if necessary. The review process should not be a mere formality or rubber-stamping exercise; it must serve as a meaningful check to ensure fairness and accountability. As the use of AI tools in HR is increasingly becoming popular, the time to get familiar with the legal issues surrounding its use is now. Build internal safeguards, update your policies, and make sure your HR team understands the tools they’re using. Because if those 90s sci-fi movies have taught us anything, it’s that leaving machines to make human decisions rarely ends well. This has happened more than a few times in recent months, and it’s worth surfacing: AI launch meetings treating compliance as the finish line… when it should be the starting point. On paper, the project looked perfect. 🔸 Documentation? Complete. 🔸 Legal sign-offs? Secured. 🔸 Regulatory boxes? All ticked! But here’s the problem, the compliance review never asked: 🔸 How were training datasets sourced and validated? 🔸 Could patients understand how the AI reached its conclusions? 🔸 Who’s accountable when the AI gets it wrong? Responsible AI starts with three pillars: 🔹 Ethical frameworks: Ground decisions in fairness, accountability, and beneficence, not just legal allowances. 🔹 Transparency: Let clinicians, patients, and regulators see how the AI works, its limits, and its data sources. 🔹 Oversight: Ensure a human is always answerable for AI actions, with mechanisms to detect and correct harm quickly. The real test of AI in healthcare isn’t whether it passes an audit, it’s whether it can earn and sustain trust. A Complex Adaptive System Framework to Regulate Artificial Intelligence . To effectively regulate AI (algorithm, training data sets, models, and applications), a novel framework based on CAS thinking is proposed, consisting of five key principles: • Establishing Guardrails and Partitions: Implement clear boundary conditions to limit undesirable AI behaviours. This includes creating "partition walls" between distinct systems and within deep learning AI models to prevent systemic failures, similar to firebreaks in forests. • Mandating Manual ‘Overrides’ and ‘Authorization Chokepoints’: Critical infrastructure should include human control mechanisms at key stages to intervene when necessary, emphasizing the need for specialized skills and dedicated attention without limiting automation of systems. Manual overrides empower humans to intervene when AI systems behave erratically or create pathways to cross-pollinate partitions. Meanwhile, multi-factor authentication authorization protocols provide robust checks before executing high-risk actions, requiring consensus from multiple credentialed humans. • Ensuring Transparency and Explainability: Open licensing of core algorithms for external audits, AI factsheets, and continuous monitoring of AI systems is crucial for accountability. There should be periodic mandatory audits for transparency and explainability. •Defining Clear Lines of AI Accountability: Mandate standardized incident reporting protocols to document any system aberrations or failures. Establish predefined liability protocols to ensure that entities or individuals are held accountable for AI-related malfunctions or unintended outcomes. This proactive stance inserts an ex-ante "Skin in the Game," ensuring that system developers and operators remain deeply invested and accountable for AI outcomes. • Creating a Specialist Regulator: Traditional regulatory mechanisms often lag the rapid pace of AI evolution. A dedicated, agile, and expert regulatory body with a broad mandate and the ability to respond swiftly is pivotal to bridging this gap, ensuring that governance remains proactive and effective. This would also entail having a national registry of algorithms as compliance and a repository of national algorithms for innovations in AI.
