Our Role in Sponsorship

If you currently hold an H-1B visa, Mitchell Martin may be able to sponsor your transfer—after you’ve been selected for one of our open positions that allows sponsorship. Once you accept an offer through MMI, our immigration team will walk you through the next steps, including required documentation, timeline expectations, and filing details.

Step 1: Getting Started

After you’re selected for a position that allows H-1B sponsorship, we’ll begin the transfer process by collecting your required documents. We then work with our immigration attorney to file a Labor Condition Application (LCA) with the U.S. Department of Labor. Once approved, we prepare and submit your H-1B petition to USCIS. This step typically takes 10–12 business days.

Step 2: Filing the Petition

You can begin working for us as soon as the H-1B transfer petition is filed with the USCIS and we obtain a delivery receipt date.  While on assignment through Mitchell Martin under an H-1B visa, you’ll provide periodic status updates and work directly with an assigned account manager who will support you throughout your engagement.

Step 3: Processing Time

The length of time it takes for the USCIS to process and approve an H-1B petition varies. It depends on the processing speed of the USCIS at the time the H-1B is filed. It normally takes between 5 to 7 months on standard processing. Premium processing is available upon request and must be covered by the candidate.

TN Visa Sponsorship for Canadian and Mexican Citizens

Citizens of Canada and Mexico may qualify for a TN visa under NAFTA (now USMCA) regulations, without the need to apply for an H-1B.

If you accept a position through Mitchell Martin that falls under a qualifying job category, our team will provide a formal offer letter and clear guidance on the required supporting documents. These typically include your resume, recent pay stubs, degree(s), transcripts, and proof of citizenship.

Most TN visa holders can present their application directly at a U.S. port of entry, making this one of the more efficient visa paths for qualified professionals.
