LARIAN STUDIOS PRIVACY POLICY

This Policy explains how we collect and use your Personal Information for our business purposes, and gives you general information on data processing at Larian Studios and on the rights you have to control your Personal Information. If you don’t understand this policy or any parts of it, you can contact us at privacy@larian.com.

For further information on specific data processing practices at Larian Studios, such as for certain games, the Larian Account or applying to work with Larian Studios, please see the PRIVACY HUB and the policies linked therein.

1. Definitions

 

"Larian Studios", "we", "us", or "our"

Larian Studios Games Ltd., an Irish company headquartered at 17A New Bride Street, Dublin 8, Ireland, and its affiliated companies.

Personal Information

Information relating to an identified or identifiable natural person, as further defined in the European General Data Protection Regulation 2016/679 (the “GDPR”), the California Consumer Privacy Act 2018 (“CCPA”), the UK General Data Protection Regulation (“UK GDPR”) and Data Protection Act 2018, and other laws as applicable.

 

2. How we collect and use your Personal Information

a) Visiting Larian Studios websites

When you visit Larian Studios websites, we receive and process your IP address, as well as Personal Information provided by cookies and similar technologies. We use this information to provide our website and online services to you, personalize your experience, remember your preferences, ensure website security, and to gather analytics about your website use. Additionally, we may use cookies and similar technologies to advertise Larian Studios Products or Services on or via our websites. For more information on our advertising practices, see Sec. d).

Your IP address is retained only during your browser session. The length of time a cookie will stay on your computer or mobile device depends on whether it is a "persistent" or "session" cookie. Larian Studios uses both types of cookies. Session cookies will only stay on your device until you stop browsing. Persistent cookies stay on your computer or mobile device until they expire or are deleted.

You can choose to enable or disable all cookies and similar technologies that are not strictly necessary for the functioning of our websites. For details on cookies and to exercise your rights, please navigate to the cookies section of the website you are currently visiting. You can change your cookie preferences at any time.

b) Playing Larian Studios games

Larian Studios games that are not governed by specific policies available in our PRIVACY HUB are subject to these general principles.

We may process data such as your gameplay logs (story or combat decisionmaking, deaths, customization decisions, locations visited, etc.) or diagnostics data you send us when you use our Crash Reporter tool. This enables us to collect statistics about and improve our games, and fix bugs and errors. Note that this information is always anonymous; Larian Studios cannot identify you from it.

Please note that using the Larian Account to access Larian Studios games and the associated online functionalities are governed by the Larian Account Privacy Policy.

a) Purchasing Larian Studios products and services

You can purchase products and services directly from us through our Larian Studios Merch Store, Kickstarter or at offline events. When you make a purchase online, you provide us with the Personal Information required to fulfill your order, including, as applicable, your name, IP address, email address, phone number, shipping address, billing address and payment information.

If you purchase Larian Studios products and services on the Merch Store using an account, we retain your contact information, shipping information and order history until you delete your account. If you purchase anything as a guest, we retain your contact information, shipping details and order history for three months after your order has been placed. In any case, we keep your invoices for seven years so we can comply with applicable legal requirements.

We may also use your email address to send you information about products or services that are similar to the products or services that you have used from us in the past. You can opt out of this use when you sign up for or purchase our products and services, and at any time using a link contained in the messages we send you.

b) Requesting support from Larian Studios

You may email support@larian.com at any time if you encounter problems or require assistance with the products and services you are receiving from Larian Studios. If you send us an email, we process your email address, name, and any information you make available to us in your email. We may also ask you for additional information, such as hardware diagnostic files, if necessary to identify and solve a problem you are experiencing, or your order details, if relating to an order you placed in our Merch Store.

We retain your support requests for a period of two years after they have been resolved.

c) Signing up for the Larian Gazette, our newsletter

When you sign up for the Larian Gazette, you provide your email address and (optionally) your name to us. We use this information to send you our newsletter. You can opt out of receiving the newsletter at any time by sending us an email or using the unsubscribe link in the footer of a newsletter email. We delete your information when you opt out of receiving the newsletter, at the latest 30 days after receiving your request.

In our newsletter, we may use pixels, link tracking and/or other analytics tools. We use these tools to help us understand whether our email was delivered, opened, and whether any links contained in it were clicked. This information is anonymized and behaviors cannot be linked to individual newsletter subscribers.

d) Larian Studios online advertisements

We may utilize cookies, pixels and/or other marketing tools to display advertisements for our products and services to you and/or track your interaction with these advertisements.

We may use third-party cookies and pixels and/or other marketing tools (such as those from Google, Meta, and other advertising networks) on our websites or in our marketing communications. Cookies are small data files containing a string of characters that are sent to your computer when you visit a website. When you visit the website again, a cookie allows that site to recognize your browser. Pixels are small graphic images (also known as web beacons, clear GIFs, or pixel tags) that can track your user behavior. We may use these technologies to help us advertise Larian Studios products or services that are relevant to your interests, measure ad performance and optimize our advertising. Where we use third-party cookies and pixels in this manner, we obtain your explicit prior consent. You can revoke this consent at any time, such as by changing your preferences in the cookies section of the website you are visiting.

Larian Studios may also work with third-party advertisers that utilize cookies and similar technologies to provide more relevant advertising about Larian Studios products across the internet. Examples of this include a display of a Larian Studios advertisement on a Facebook page, on a Google-owned page such as a search results page or YouTube, or on a site within Google's advertising network. We do not share Personal Information we have obtained from you with third parties as part of this process. The processing of your Personal Information to provide advertisements on third-party platforms is subject to the privacy practices and policies of these platforms. You can opt out of receiving personalized ads from third party advertisers and ad networks who are members of the Network Advertising Initiative (NAI) or who follow the Digital Advertising Alliance's Self-Regulatory Principles for Online Behavioral Advertising by visiting the opt-out page on the NAI website (https://thenai.org/how-to-opt-out/) or using the WebChoices tool by the DAA (https://optout.aboutads.info/). Electing to opt out of any interest-based advertising may make the ads you see on the internet less relevant to you.

e) Interacting with Larian Studios on social media, the Larian forum and Discord

When you interact with us on social media, in our forum or on the Larian Studios Discord, such as by reacting to or commenting on our posts, messaging, following or tagging us, we may see this interaction and respond. We also analyze online sentiment regarding Larian Studios directly and through service providers. This means we may see your account name, handle and profile picture, as well as the content of your interaction. When you visit the Larian Forum, we also collect your IP address and information provided by cookies or similar technologies. In any case, we never download and/or save your social media activities outside of the platforms you are using. The processing and storage of your Personal Information on the platforms you are using is subject to those platforms’ privacy practices and policies.

The Larian Studios Discord server and forum are moderated to prevent inappropriate interactions, and your interactions can be used to make moderation decisions.

f) Visiting Larian Studios at events

Occasionally, we are present at conventions, expos, or other events. During these events, we may be taking photographs and/or videos, which we use for business purposes including posting them on social media. It is not our intention to center you individually in these photographs and/or videos, but due to the nature of the event and high volume of visitors you may be visible in photographs and/or videos we take when you attend an event. We will not feature you as the main focus of a photograph and/or video unless we have obtained your prior consent, which you can revoke at any time. Event organizers’ terms may also apply.

g) Helping out at Larian Studios

Occasionally, we engage people to help us with limited-scope activities like convention staffing or moderation of our Discord server. When you apply to participate in these activities, you send us your Personal Information, such as your name and contact details. Engaging in these activities requires that we process your Personal Information to select you for the activity and communicate with you. We delete your Personal Information in accordance with statutory retention periods after your activity has concluded.

h) Participating in Larian Studios playtests

Occasionally, we conduct public playtests for our games. You can apply to participate in these playtests when we advertise them. This requires you to provide Personal Information including your contact details, demographic information like age and gender, and relevant experience (e.g., with games of a specific genre or previous Larian Studios games). We use this information to select playtest participants, and to communicate with you before and during the playtest. If you have given us your consent to contact you for future playtesting opportunities, we retain this information for the period specified in our request.

We ask you to submit feedback during the playtest, which we retain in pseudonymized form. After a playtest has concluded, we delete all identifying information and links, so your feedback can no longer be attributed to you individually.

i) Doing business with Larian Studios

Running our business involves collaborating with different partners for a variety of purposes. If we establish a business relationship with you, we collect the Personal Information of the representatives of all involved parties, such as their name, role and contact details, for contract management and business communications.

3. Lawful bases for processing

If you are located in the EEA, UK or another jurisdiction in which the disclosure of legal justifications for processing Personal Information is required, our lawful bases for processing are as follows:

  • Necessity for contract performance or to take steps at your request prior to entering into a contract

We need to process your Personal Information to provide you with our goods and services, such as our websites or games, when you order from our Merch Store, when you request support from us, when you apply to volunteer with us or to participate in our playtests. We exchange Personal Information when we do business with you or are considering whether to enter into a business relationship with you.

  • Necessity for compliance with our legal obligations

As a business, we are subject to various regulatory requirements such as under tax law, civil law, and criminal law. We retain information such as invoices from your orders and moderate our online spaces to comply with these obligations.

  • Consent

We ask for your consent when you sign up for our newsletter, the Larian Gazette, or when we use cookies, pixels and/or other tools for advertising.

  • Necessity for our legitimate interests

Our legitimate interests include taking photos and videos at events, engaging on social media to interact with our fans or analyze online sentiment, and exercising or defending ourselves against legal claims.

 

4. How we do not use your Personal Information

We never engage in the following types of processing regarding your personal data:

1. Profiling

Larian Studios does not use your Personal Information to profile you or to make automated decisions affecting your rights and freedoms as a data subject.

2. Selling or sharing your Personal Information

We never sell or share your Personal Information for cross-context behavioral advertising.

 

5. How we disclose your Personal Information

In the course of our business activities, we disclose your Personal Information to different recipients, such as tool or service providers we use, as we deem necessary to provide our products and services to you. This includes the following categories of recipients:

  • Affiliates and subsidiaries. Data may be shared within and between Larian Studios affiliates and subsidiaries to enable us to provide you with our products and services. These affiliates and subsidiaries are located in different countries around the world. This means that your personal information may be transferred to the EEA, UK, Canada and Malaysia. Every Larian Studios entity adheres to the principles and restrictions set forth in this Policy.
  • Service providers. Larian Studios uses a variety of third-party vendors to perform services, such as webhosting and infrastructure services; payment services, order fulfilment and shipping providers for purchases in our Merch Store; email platform services for our newsletter; and ticket platform services for support requests. We share your data with these vendors to enable us to provide the applicable services to you. You can request an up-to-date list of these parties from Larian Studios at any time.
  • Recipients required by law or legal proceedings. It may be necessary for us to share data with third parties when we reasonably believe it is required by law or in connection with legal proceedings; to prevent harm to Larian Studios or its customers; for the prevention and detection of crime or the apprehension or prosecution of offenders; or to protect the rights or property of Larian Studios. This may include local public or criminal authorities or courts.
  • Merger, acquisition, or sale of assets. We may share your Personal Information with parties with whom it might be necessary to complete a financial or corporate transaction, such as a merger or sale of assets.

All recipients are required to protect the Personal Information they receive from us or collect on our behalf and put in place appropriate security measures and safeguards.

Wherever the above disclosures involve transferring your Personal Information internationally, including from within the European Economic Area to a third country, we have put in place appropriate safeguards to protect the safety of your Personal Information in line with this Privacy Policy, including Standard Contractual Clauses and certification under the EU-US Data Privacy Framework.

Note that in some cases, such as purchasing our games in third-party applications like Steam or GOG, visiting our social media pages, or clicking links on our websites, your Personal Information may be processed by third parties outside of our control. These parties’ privacy practices may differ from those of Larian Studios, and any data shared with or received by them is subject to their own privacy statements.

 

6. Your rights

Depending on the jurisdiction you reside in, you have various rights relating to your Personal Information. You can exercise these rights by emailing us at privacy@larian.com. Please be advised that we may first be required to verify your identity before processing your request. If you have a Larian Account, you can also view, edit and delete your Personal Information in your account settings. If you exercise your rights with us, we will comply with your request or initiate additional communications within 30 days.

In principle, you do not have to pay to exercise any of these rights with us. However, we may charge a reasonable fee or refuse to comply with your request if your request is clearly unfounded or excessive.

Your rights include:

a) Deletion

You can request that we delete all or part of the Personal Information we hold about you. We will accommodate this request unless we are legally required or authorized to retain specific data. Note that when you request full or partial deletion, we may no longer be able to provide you with our products and services.

b) Correction

You can request that we correct outdated, inaccurate or incomplete Personal Information we hold about you. We will accommodate this request to the extent of our technical ability.

c) Access

You have the right to obtain access to, or a copy of, the Personal Information we hold about you, as well as to receive further information about our processing activities.

d) Data portability

Where we have processed your data by automated means, you have the right to obtain the Personal Information we hold about you in a structured, commonly used, and machine-readable format, and to transfer this data to another data controller. We will accommodate this request to the extent of our technical ability.

e) Objection

You have the right to object to the processing of your Personal Information that we carry out in our legitimate interest. If you object, we will cease processing your Personal Information unless there are compelling legitimate grounds for the processing which override your interests, rights and freedoms, or if we require it for the establishment, exercise or defense of legal claims.

You also have the right to object to the use of your Personal Information for direct marketing at all times. We may use direct marketing to inform you about products and services that are similar to products and services you have received from us previously and to provide you with our newsletter, the Larian Gazette. You can unsubscribe from these communications at any time by using the unsubscribe link in the footer of the email.

f) Right to withdraw consent

Where we process your Personal Information with your consent, you have the right to withdraw this consent at any time. If you signed up to the Larian Gazette newsletter, you can also unsubscribe by using the unsubscribe link in the footer of the newsletter.

g) California residents: Objection to the sale or sharing of your personal data

You have the right to object to the sale or sharing of your personal data for cross-context behavioral advertising. Please note that Larian Studios does not engage in the sale or sharing of your personal data within the scope of the CCPA.

h) UK residents: Complaint

If you believe that we have infringed applicable data protection laws by our handling of your Personal Information, you can raise a complaint with us. Note that you are not required to complain to us before you raise a complaint with your competent supervisory authority.

 

7. Complaining to a supervisory authority

If you believe that Larian Studios processes your Personal Information unlawfully, you have the right to file a complaint with the supervisory authority responsible for Larian Studios, or with another supervisory authority (such as the one in your home country).

8. Changes to this Policy

We update this Policy from time to time to reflect changes in applicable laws, our business operations, technology, or other reasons we deem necessary or appropriate.

When we make changes, we update the “Last modified” date above and post the new policy to our websites. If we make material changes to the ways in which we process your Personal Information while we currently hold Personal Information about you, we will provide you with additional advance notice.

We encourage you to periodically review this and other Policies to learn more about how Larian Studios is using and protecting your information.
