In a recent Los Angeles Times op-ed, former economic advisor Robert Wolf examines what prolonged regulatory uncertainty around major transactions can mean for American businesses and the economy.   Careful review is an important part of the process. But as industries face growing competition and rapid technological change, extended delays can become an obstacle to investment and innovation.   The goal should be a process that protects competition without standing in the way of progress. https://lnkd.in/e8iFpCGk

States can pursue politically motivated lawsuits with zero risk to themselves, while companies bear enormous costs from litigation and delay regardless of the outcome. Nexstar confronted this same imbalance and sought a bond in its own litigation, but the amount granted was wholly insufficient to account for the potential harm that flows from plaintiffs' lawsuit. Paramount’s request underscores why plaintiffs seeking to block federally approved transactions should be required to bear some risk in the event they fail to prove their claims. https://lnkd.in/eeHFrMBU

“The future of local television should not be determined by regulations written before streaming, smartphones, and digital competition transformed the media landscape... The FCC is finally giving [local broadcasters] room to compete for investment and survive.”   Dr. Roslyn Layton, a leading tech policy researcher, argues the FCC’s repeal of the 39% national television ownership cap is an important step toward modernizing rules created for the previous century.   The need for local journalism hasn't changed, but the regulations that govern it need to.
