Greetings, Pleased see the attached correspondence from the Empowered Community Administration certifying the decisions made by each Decisional Participant regarding the Fundamental Bylaw change proposed by the ICANN Board of Directors in their Board resolution 2017.05.18.04 - 2017.05.18.07. I am pleased to report that all five Decisional Participants, through their internal procedures, reached a decision regarding the matter before them, and further, that all five Decisional Participants approved the proposed Bylaw change. Hello James and everyone, Assuming there is no hindrance (e.g. in the form of a ccNSO member’s objection in the few hours we have left until 06.59 UTC on 21 July), then, yes, the amendment will pass successfully, whether or not the GAC decides to support, object or abstain. Once we have confirmation from the ccNSO that their approval vote remains unchanged, and we hear from the GAC as to their final decision, this information can all be plugged into the draft notice for one of you to send (e.g. Stephen?). For your reference, I have included the ccNSO Council Resolution to that effect, which has become effective today. The ccTLD community was informed by the chair of the ccNSO (https://community.icann.org/display/ccnsowkspc/Fundamental+Bylaws+change%3A +reconsideration+process+responsibilities?preview=/64082399/66069523/%5Bccns o-members%5D%20ICANN%20Board%20adopted%20the%20proposed%20Bylaws%20change%20 (Sataki).pdf) ) of the intended amendment of a Fundamental Bylaw change and of the upcoming Approval Action Community Forum during ICANN 59. Following the letter of the chair, 33 ccTLD managers expressed their support for the amendment and one expressed its abstention. At the Approval Action Community Forum (27 June 2017) no objections were expressed to the amendment. At the ccNSO Session on the topic, the vast majority of the ccTLDs present supported the proposed Fundamental Bylaw amendment. Decision In accordance with section 6.1 (a) and Annex D section 1.4 (a) the ccNSO Council as one of the Decisional Participants, APPROVES the amendment of section 4.3 as proposed. This decision becomes effective 7 days after publication of this resolution on the ccNSO website. The chair of the ccNSO is requested to notify the Empowered Community Administration in writing of this decision as soon as possible and forward this notice to the Secretary.

ALAC Decision: Proposed Revision to Fundamental Bylaw

To the ICANN Empowered Community Administration: The ALAC conducted an online vote during the period 13-19 July 2017 on whether there ALAC supports the proposed ICANN Fundamental Bylaw revision creating the Board Accountability Mechanisms Committee. In accordance with ALAC Rules of Procedure 24.1 All decisions of the ALAC exercising its power within the EC must be decided by an affirmative vote of at least two-thirds of the sitting ALAC Members. With 14 of 15 ALAC Members voting, 13 Members voted to approve the Bylaw revision and 1 Member voted to reject the Bylaw revision. Accordingly, with more than two-thirds of sitting ALAC Members casting an approving vote, the ALAC supports the proposed Fundamental Bylaw Revision. FOR YOUR ACTION: Sending of notice to ICANN Secretary to terminate Rejection Process

Dear members of the Empowered Community Administration, This note is to inform you that, as of the end of the Rejection Action Petition Period (16 July 2017), we have not seen any indication of a petition submitted to any of the Decisional Participants to initiate the Rejection Process, outlined in Section 2.2 of Annex D of the ICANN Bylaws, in relation to the ICANN FY18 Budget & Operating Plan, IANA FY18 Budget, or the 5-year ICANN Operating Plan. As such, under Section 2.2(c)(ii) of Annex D, the Empowered Community Administration has twenty-four (24) hours to send a notice to the ICANN Secretary certifying that the Rejection Process has been terminated. Attached please find a draft template notice for your consideration. The next step is for one of the five Administration members to send the notice to the ICANN Secretary.
