Europe’s AI rules are being written right now. Yesterday, our CLO Dr. Robert Kilian had a seat at the table. 💡 As a board member of the KI Bundesverband, Robert was invited as an expert witness to the German Bundestag’s Committee on Digital Affairs, for the public hearing on the government’s draft law implementing the EU AI Act (KI-MIG-E). 🌍 His statement emphasizes some key points: - Supervisory architecture and fragmentation. Designating the Federal Network Agency (BNetzA) as the central market surveillance authority is the right call. But without legally binding coordination obligations between federal and state levels, enforcement risks becoming fragmented, with real competitive consequences for companies that simply cannot navigate 16 diverging interpretations of the same regulation. - AI regulatory sandboxes need to include a conformity pathway. Sandboxes only work if companies trust them. That means: structural separation between sandbox operations and market surveillance, priority access for SMEs, mandatory compliance training as part of the sandbox programme, including gap analyses that show companies exactly which technical tests still need to be completed, and an exit report that does not merely document, but functions as an integrated conformity pathway leading directly toward certification. - Predictable supervision. Modelled on the BaFin circular system: regular AI circulars from the BNetzA, developed with meaningful SME and startup input, so that compliance becomes plannable, not a guessing game. - SME representation in the national advisory body. The draft law does not provide for a dedicated national advisory body at the BNetzA. It should. One where companies with hands-on implementation experience have a guaranteed seat, as a structural check on how supervision is shaped in practice. - Technical standards – play a crucial role in turning the #AI Act’s requirements into practical compliance, but are still in draft status, which brings legal uncertainty. Yes, the #EU AI Act and its implementation are a complex endeavour, and we need pragmatic legislation that helps support innovation while giving guardrails for the responsible use of this powerful technology. Getting the implementation right is a crucial step for the future of European AI. Let’s do our best to combine powerful technology with European values such as privacy, transparency, and the rule of #law. ✅
